Dewey-Burdock ISR Project Documents Pertaining to Section 106 of the National Historic Preservation Act

On August 10, 2009, Powertech (USA), Inc. (Powertech) submitted an application for a U.S. Nuclear Regulatory Commission (NRC) source material license to construct and operate an in situ recovery (ISR) facility at the proposed Dewey-Burdock ISR Project site and to conduct aquifer restoration, site decommissioning, and reclamation activities.  The proposed ISR project site is located in Custer and Fall River Counties, South Dakota.

The NRC staff prepared a Supplemental Environmental Impact Statement in accordance with Title 10 of the Code of Federal Regulations Part 51 (10 CFR Part 51), which implements the requirements of the National Environmental Policy Act of 1969, as amended (NEPA).  The NRC staff also conducted a Section 106 review in accordance with the National Historic Preservation Act of 1966, as amended (NHPA).  NRC staff initiated its consultation under Section 106 for the proposed Dewey-Burdock ISR facility in March and September 2010.  The NRC has since met the content and spirit of NHPA and has completed its Section 106 review.

During the Section 106 review process, the NRC staff consulted with the South Dakota State Historic Preservation Officer (SHPO), Advisory Council on Historic Preservation (ACHP), Bureau of Land Management (BLM), and interested Tribes to identify historic properties, including sites of religious and cultural significance to the Tribes.  As part of the Section 106 review process, the NRC developed a programmatic agreement (PA), which details cultural resource findings, determinations for the National Register of Historic Places (NRHP), and mitigation measures.

The NRC's final Programmatic Agreement and information related to the Section 106 activities is available via the links below.
